Let Us Talk To The Insurers
Often, people who have been injured in a car accident or at an area business, they may hear from the other party’s attorney even as they are just arriving home after receiving medical care. It’s common for insurance companies to call to ‘check’ on the well-being of people who have been injured. Keep in mind that for insurers to profit in their business, they need to pay out as little as possible. It’s never advisable to speak to them or sign any forms without consulting your own attorney. Even though the insurance representatives sound kind and caring, your discourse could ultimately be held against you. We advise our clients to let our legal professionals do the talking. While you recover, we work on your behalf to get the compensation you deserve.
Negotiation Or Litigation?
Malik Law can negotiate or litigate your case. Achieving a settlement is ideal as it saves time and a court battle. Often, when the defendant’s guilt in the matter is overwhelmingly obvious, they will try to work out a settlement. We will aggressively pursue a settlement that’s in your best interest. We won’t agree to any terms, however, without your consent. Too often, the defendant does not want to pay fair compensation and so we must escalate the matter to litigation. When litigating a personal injury case, we’ll examine it from every possible angle. We’ll aggressively represent your claim in court, doing our utmost to win you fair compensation for your injuries.
Have You Suffered A Personal Injury?
If you have been injured in a car accident, bicycle accident, or slip and fall accident, the first thing you must do is seek medical treatment. Naturally, this is for the sake of your own health and well-being. However, should you choose to file a claim in the future, you will need documentary medical evidence. A visit to your doctor or an emergency room will provide you with the first documents of medical assessment of your injury. These are important to the eventual success of your claim.
If possible, it’s helpful to get any names, numbers, and addresses of people who witnessed your accident. A police report or incident report will also be helpful to you if you pursue the matter legally. Sometimes a person’s injuries are too serious for them to gather any of this information. Our attorneys have access to resources. We can also help gather evidence that supports your claim.
What Kind Of Compensation Am I Entitled To?
People who have suffered a personal injury in the state of Colorado may be eligible for economic damages and non-economic damages. Economic damages refer to medical costs related to the injury. They may include future medical costs if the injuries will require future or on-going care. These damages can also include missed work. Non-economic compensation refers to the pain, suffering, and emotional turmoil that the injury caused.
If you’ve suffered as a result of your injury, you have a right to file a claim. Remember, however, that there are limitations in place. You must file your claim within a certain period of time from the time you were injured. Malik Law can advise you about these time limits and examine your claim, helping you determine what course to take.
Negligence And Personal Injury Law
When you consult with Attorney Malik or her legal associates, she can advise you about your claim. To prove that a defendant has been negligent or careless, you’ll need to be able to establish four specific elements:
- You have to prove that the defendant had a duty to employ reasonable caution and failed to.
- You have to show evidence the defendant had a breach of legal duty to provide this care.
- You must be able to show a clear link between their breach and the accident that led to your injuries.
- You must be able to prove that you have suffered because of your injuries.
Malik Law attorneys have experience establishing these elements for our clients. Although Colorado has issued compensation caps, we will do everything we can to secure our clients a lucrative compensation package that is in keeping with what they’ve endured.
If you or a loved one has been seriously injured because of someone else’s careless, negligence, or recklessness, you may be eligible for compensation. We invite you to consult with us about your claim. We will carefully evaluate it and discuss the most viable options before you. If you choose to let us represent you, we will do so faithfully and diligently. We will stand by you during the entire legal process, doing everything we can to aggressively represent your interests.
